Selecting an Adjudicator
At your request, an Intelligent Justice approved provider will contact all of the parties and arrange for the joint selection of a highly credentialed Adjudicator who will preside over the swift resolution of your dispute. Analyzing the Dispute
The parties will promptly meet with the Adjudicator to identify their claims and defenses as well as the likely sources of relevant evidence. The adjudication process commences immediately with:
- a rigorous analysis of the applicable law,
- a prompt review of the written evidence and
- a thorough examination of the witnesses under oath
All of the legal work is performed by the jointly selected Adjudicator. Relevant evidence is obtained through voluntary production to the Adjudicator or, when necessary, via subpoena. The Adjudicator will decide all disputed issues of fact and serve as the judge of the claims and defenses of all the parties. There is no need for an expensive separate trial. A detailed written decision is provided to each of the parties at the conclusion of the process.
The Evidence
At the conclusion of the adjudication process the Adjudicator will provide the parties with a detailed written compilation of the evidence that is most relevant to the liability claims and defenses in the dispute. The parties then will have a short period to review the evidence and pursue a settlement, if they so desire.
The Verdict
If a settlement is not swiftly achieved, the Adjudicator will promptly issue a written verdict deciding all issues of liability associated with the parties’ claims and defenses. If the verdict is in favor of the defendant on all legal claims, the adjudication will then be completed. If the verdict is in favor of the claimant, the parties will have a second brief period to pursue a negotiated settlement of the issues related to damages and any other legal remedies requested by the claimant before the Adjudicator issues a final written verdict deciding what, if any, relief the claimant is entitled to receive.
The Judgment
The written decisions of the Adjudicator may be converted into an enforceable court judgment by any party in the same manner that an arbitration award is swiftly confirmed as a judgment within the public court system.
Following the Rules
During the adjudication the parties will adhere to a written agreement to suspend all other litigation options and abide by the Intelligent Justice Adjudication Rules and Procedures. There is no role in the Intelligent Justice system for expensive lawyers acting as inefficient, partisan advocates. The parties are free, however, to have separate counsel monitor the process or explore opportunities for settlement.
